You agree to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party, such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.

This site and the information, names, images, pictures, logos and icons regarding or relating to Eden Project Communities and/or the Eden Project, its products and services (or to third party products and services), is provided “as is” and on an “is available” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. In no event will Eden Project Communities and/or the Eden Project be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortuous action, arising out of or in connection with the use of the site. Eden Project Communities does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. From time to time we may publish links to websites which we feel could be of interest to you. We make every effort to ensure that the sites we recommend reflect the policies in our Eden Project Guidelines, although we cannot be held responsible for the content of any external web sites.

The names, images and logos identifying Eden Project Communities or third parties and their products and services are proprietary marks of the Eden Project and/or third parties. Nothing contained herein shall be construed as conferring by implication or otherwise any license or right under any trademark or patent of Eden Project Communities, Eden Project or any other third party. Any material found within the pages of https://www.edenprojectcommunities.com/, including text or images may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial use. Permission for any other use must be obtained by contacting Eden Project Communities. We allow you onto this website in return for you agreeing not to adapt, alter or create any derivative work from any of the material contained in this site. In addition, the material cannot be used for any other purpose other than for your own personal and non-commercial use unless the appropriate license has been granted by Eden Projecty Communities.

 

4. The Big Lunch Products

All products and services mentioned in this site are subject to availability and are available at the sole discretion of Eden Project Communities.

 

5. Indemnity

You agree to indemnify and keep indemnified Eden Project Communities from and against all claims, damages, expenses, costs and liabilities arising in any manner from your entry to and use of the site other than in accordance with these terms and conditions.

 

6. Law and Jurisdiction

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining Terms and Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales.

 

7. Rules and Regulations

Occasionally within the site you may find other rules or terms relating to specific material which may conflict with or contradict these terms and conditions. These could be rules for competitions, specific download requirements, or prize draws, for example. If there is any conflict then the rules or terms relating to specific material will win out over the more general terms and conditions.

 

Eden Project Communities – Event Terms And Conditions

 

1. Definitions

In these Conditions the following definitions shall apply:

“Event” means any event we run online or in person, including; Community Camp, the Festival of Discovery, online workshops or talks and regional events.

“Conditions” means these terms and conditions of entry for the Event.

“we”, “us”, “our”, or “the Event Organisers” means: (1) Eden Project Communities, part of The Eden Project, a registered charity in England and Wales; (2) The Big Lunch, an Eden Project Communities initiative; (3) partners/ organisations we run any Events with; (4) project partners including The National Lottery / Camelot and Iceland and The Food Warehouse.

“you”, “your”, “Participant” means the entrant to the Event named on the application or registration form or, where you are signing as a parent or guardian for a child aged under 18 for whom you are responsible, your child.

  • Registration or attendance at an Event does not include entry to the Eden Project unless otherwise stated.
  • To help us provide the most inclusive Events, we ask you to provide any access requirements you may have when registering or applying for an Event.
  • You are advised to check you receive a registration email for an Event. Please check your spam/ junk boxes if you cannot find this.
  • Please be ready to join any Event a few minutes early to minimise disruption.
  • At our events please only share information you are comfortable sharing and report any concerns you have to a member of the Eden Project Communities team.
  • Dogs are not permitted to any in person event, except for assistance dogs.
  • If you have attended a Community Camp before (at Eden or online) you will not be eligible to attend another, due to our funding conditions.

The following are not permitted at an Eden Project Communities event;

  • alcohol (other than that sold at the event by the Eden Project, or a licenced premises we are hosting an event in);
  • weapons, ammunition, explosives, fireworks, flares, laser pens, or any other item which may be interpreted as a potential weapon including sharp or pointed objects (e.g. knives);
  • illegal substances

Age restriction

Our Events are for adults over 18, unless otherwise stated.

 Children under 18 may attend an online event at their parent/ guardians discretion and with their parent/ guardians supervision throughout.

 At our discretion we may let children over 16 attend an in person Event with permission from their parent/ guardian aged 18 or over and provided they attend the event throughout with a parent/ guardian aged 18 or over. 

Event ejection

We reserve the right to refuse entry to an Event, to ask you to leave, or to remove you if on Zoom if:

(a) you attempt to participate in an Event in a manner that we, acting reasonably, believe:

           (i) may cause injury to you or another participant;

           (ii) may damage or harm the environment;

           (iii) in our opinion is likely to cause offence; or

           (iv) otherwise causes a risk or potential risk to health and safety;

(b) in our opinion you are unfit to participate in an Event due to:

           (i) the consumption or use of alcohol or drugs;

           (ii) an injury or illness;

Online events

Our online events are open to the public. Information you share on these sessions, or use to attend them may be visible to other attendees during the session and in a recording, which can be viewed by others online. This information may include, but is not limited to; your name as it appears on the screen, phone number if you attend on a phone, your image/ video on Zoom, any noise if your microphone is unmuted and comments you write in the chat box.

Photographs, video & recording

We often take photographs/ footage at online and in person events, including recording sessions on Zoom, all of which may be used in our marketing. Recordings of online events may also be shared online so people can watch them later.

At an online Event if you don’t want to appear in any photographs/ footage please turn your video off and keep your microphone muted.

At an in person Event please let a member of the Eden Project Communities team know in advance if you don’t want to be in any photographs/ footage.

Unless you take the mitigations mentioned above, by attending any of our Events you grant us the right to use the photograph(s) and/or footage resulting from the event, and any reproductions or adaptations of the photograph(s) and/or footage for all general purposes in relation to Eden Project Communities initiatives including The Big Lunch partnered with The National Lottery / Camelot, Iceland and The Food Warehouse and all direct sponsors and partners for any element of the Eden Project Communities programme including, without limitation, the right to use them for TV, promotional films, online and in any publicity materials, books, newspapers, magazine articles and social media marketing, whenever Eden Project Communities initiatives including The Big Lunch partnered with The National Lottery / Camelot and Iceland and The Food Warehouse choose to do so.

Event Cancellation

Note that an event beyond Eden Project Communities reasonable control may require us to cancel and/or postpone one of our Events. These could include but are not limited to: an earthquake, flood, snow, storms, fire, typhoon and other natural disasters, acts of God, war, revolution, armed conflict, terrorist attack, a spreading infection, epidemic, pandemic or any other disease.

We cannot guarantee to inform you of any change or cancellation of any event or be held responsible for refunds or for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.

General

Any personal data that we collect, use or process in relation to an agreement concluded with you in connection with these terms and conditions will be dealt with in accordance with our Privacy Policy.

Neither Eden nor any of its directors, employees or agents will be liable for any damage or loss to your personal property that you otherwise incur as a result of an Event.

Eden does not seek to exclude its liability to you for death or personal injury caused by its negligence, fraud or any other liability which cannot lawfully be excluded or limited.

Your statutory rights are not affected.

If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions are not affected and will remain in force.
